These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (the “user”, “you”, or “seller”) and SellMyCell LLC, a company registered in the Commonwealth of Virginia, governing your access to and use of our services, including any websites, applications, or platforms operated by us (collectively, the “Services”). By accessing or using any part of our Services—including  receiving a device quote, shipping us your electronics, or receiving payment—you acknowledge that you have read, understood, and agreed to be bound by these Terms in full. If you do not accept or agree to these Terms, you must immediately discontinue your use of our Services.
1. Eligibility and Jurisdiction
You must be at least eighteen (18) years of age and legally capable of entering into binding contracts to use our Services. By engaging with our platform, you affirm that you reside in the United States and that you are not prohibited under any applicable law from selling electronic devices. SellMyCell only operates within the jurisdiction of the United States, and any attempt to use our Services from outside of this region may be blocked or disregarded. Our services are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. You agree that any legal disputes shall be resolved exclusively in the state or federal courts located in Virginia.
2. Description of the Service
SellMyCell offers an online platform that allows users to sell a variety of electronic devices, including but not limited to smartphones, tablets, smartwatches, laptops, computers, VR headsets, and other consumer electronics. Users can receive real-time quotes based on the provided device information, ship the device to us using a prepaid label, and receive compensation upon completion of inspection and acceptance of the final offer. We utilize automated tools (e.g., Reusely) to generate market-reflective offers and handle quote generation, logistics, and payment processing. While we strive to maintain accurate pricing, we reserve the right to modify or withdraw any quote at our discretion and without liability, especially if we determine that the information provided by the user is inaccurate or misleading.
3. User Representations and Legal Ownership
By submitting a device for sale, you represent and warrant that you are the rightful and lawful owner of the device, or you have the explicit legal authority to sell it. You further confirm that the device is not stolen, lost, counterfeit, or acquired through fraudulent or deceptive means. We accept financed or blacklisted devices; however, you explicitly agree and acknowledge that submission of such devices does not absolve you of the legal responsibility to ensure the device is not reported as stolen or under active investigation. Submitting stolen devices may lead to cooperation with law enforcement, denial of service, and forfeiture of the device. We reserve the right to refuse, hold, or report any device we deem suspicious. We also reserve the right to verify ownership and may request additional proof or documentation before proceeding with an offer or payment.
4. Device Evaluation and Offer Process
All device offers are conditional and subject to a physical inspection of the item(s) once received at our facility. You agree that the quote provided at the time of submission is preliminary, based solely on the information you provide. Upon receipt of the device, our technicians will evaluate the device’s physical and functional condition, which may include checks for: ? Screen cracks, discoloration, or damage ? Frame dents, bends, or wear ? Battery performance and charging integrity? Functional buttons, cameras, microphones, and speakers ? Lock or account activation status (e.g., iCloud, Google FRP) ? Whether the device is reported lost, stolen, or blacklisted If the device matches your original description, the quote will be honored. If there are discrepancies, a revised offer will be sent to you via email or your online portal. You will have five(5) business days to accept or reject the revised offer. If no response is received within this period, we reserve the right to automatically process the revised offer and issue payment accordingly. Should you choose to reject the revised offer, your device will be returned to you at no cost using standard shipping methods.
5. Shipping and Risk of Loss
We provide prepaid shipping labels for device submission. It is your responsibility to properly and securely package your device to ensure safe transit. We are not responsible for any damage that occurs in transit due to inadequate packaging. Risk of loss passes to us only once the device is physically received and signed for at our processing facility. If a shipment is lost, stolen, or damaged in transit before arriving at our facility, you must contact the carrier to file a claim, and we will provide supporting documentation where appropriate. Devices returned to you following a rejected offer will be shipped using standard, non-insured services unless specifically requested otherwise. We are not liable for loss or damage during return shipping unless such shipping was handled negligently by our service. For devices exceeding 15 pounds or 2000 cubic inches, the customer is responsible for return shipping fees. We do not cover shipping costs for devices exceeding this threshold.
6. Data Collection and Privacy
We collect certain personal information in order to process transactions and provide services. This may include your name, address, phone number, and email address. By using our Services, you agree that we may collect and store this data in accordance with our Privacy Policy, which outlines how your data is handled, stored, and protected. Your information will never be shared with third parties without your consent, except as necessary to complete the transaction (e.g., payment processing) or as required by law.
7. Device Lifecycle (Recycling,Refurbishment, and Parts Sales)
After we receive and inspect your device, we may refurbish it, recycle it, or sell parts from the device. By submitting your device for sale, you agree to transfer all ownership rights to us, and we reserve the right to do so at our discretion. We may resell, recycle, or dismantle the device for parts.
8. Refusal of Service and User Bans
We reserve the right to refuse service to any individual or entity at our discretion. This includes, but is not limited to: ? Users who provide false, inaccurate, or misleading device information. ? Users submitting stolen or counterfeit devices. ?Users engaging in fraudulent activity or attempting to manipulate offers. In such cases, we reserve the right to report such activity to law enforcement and deny any further service to the user, including permanently banning the user from accessing our platform.
9. Fees for Fraudulent Transactions
We do not charge any fees unless we deem the transaction to be fraudulent, in which case we may assess reasonable administrative charges or reject the transaction outright. If the device condition is found to differ from the provided description or our inspection reveals fraudulent intent, we may revise the offer or deny payment entirely.
10. Payment Methods and Timeline
Once your device has been inspected and the original or revised offer is accepted, payment will be issued within 48 hours (excluding weekends and holidays) through your selected method: ? PayPal ? Venmo ? Zelle ? CashApp ? Bank Transfer (ACH) ? Amazon Gift Card ? Or as provided All payments are final and non-reversible. You are solely responsible for providing accurate payment information, and we are not liable for delays or losses due to typographical errors, incorrect usernames, or closed accounts. In the event of failed payment delivery, we will attempt to contact you once; failure to respond within ten (10) business days may result in forfeiture of payment.
11. Bulk Sellers and Commercial Transactions
We welcome bulk sellers and businesses looking to liquidate devices. If you are selling large quantities of devices (more than five devices in one transaction), please contact us to discuss your requirements. Bulk sellers may be subject to separate terms, including but not limited to: ? Special rates ? Bulk shipping instructions ? Additional verification of business identity Please reach out to our customer support team to initiate a bulk seller transaction.
12. Intellectual Property
All content on our website—including logos, trademarks, images, software, text, and designs—are the exclusive intellectual property of SellMyCell LLC or its licensors. You may not copy, reproduce, distribute, transmit, modify, or otherwise exploit our content for commercial purposes without express written permission.
13. Limitation of Liability
To the maximum extent permitted by law, SellMyCell LLC shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, income, business, or goodwill, even if we were advised of the possibility of such damages. Our total liability for any claim related to your use of the Services shall not exceed the final value offered and paid for your submitted device.
14. Indemnification
You agree to defend, indemnify, and hold harmless SellMyCell LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses—including legal fees—arising out of or related to your breach of these Terms, violation of any applicable law, or submission of devices in violation of third-party rights.
15. Modifications and Updates
SellMyCell LLC reserves the right to revise these Terms at any time. Updated versions will be posted on our website and are effective immediately upon posting. Your continued use of our Services constitutes your acceptance of such modifications. It is your responsibility to review these Terms periodically to remain informed of any changes.
16. Entire Agreement
These Terms, along with our Privacy Policy and any supplementary policies posted on our website, constitute the entire agreement between you and SellMyCell LLC concerning your use of the Services and supersede all prior or contemporaneous communications, whether oral or written.
